Terms of Sale and Use

The terms governing your use of Beeloc: consent-based location, reverse lookups, the subscription and the applicable law.

1. Publisher, contact and hosting

1.1 https://www.beeloc.com and the Beeloc service are published by Beeloc Technology Limited (C 116833), whose registered office is at . Correspondence regarding these Terms is received at [email protected].

1.2 The Site is hosted by OVHcloud (OVH SAS)., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus (https://www.ovhcloud.com).


2. Terms used in these Terms

2.1 The following words have the meanings set out below.

Customer
Any individual or legal entity subscribing to the Services, whether as a consumer or in a professional capacity.
Account
The secure personal area from which requests are sent and results consulted.
Location Request
The sending, to a number supplied by the Customer, of a text message containing their message and a unique location link.
Recipient
The holder of the number to which a Location Request is addressed.
Position
The location data transmitted by the Recipient's device at the moment they open the link.
Reverse Lookup
The consultation, from a telephone number or a username, of the publicly available information associated with it.
Trial Offer
The paid introductory period described in clause 9, at the end of which the monthly subscription begins.

3. Scope and acceptance

3.1 These Terms govern the entire relationship between Beeloc and the Customer, to the exclusion of any other document. Subscribing constitutes unreserved acceptance.

3.2 Beeloc may amend these Terms. The version that applies is the one in force on the date of the order; any material change is notified by email at least thirty (30) days before it takes effect.

3.3 The Services are available only to persons aged eighteen (18) or over who have legal capacity to contract.


4. Purpose of the Services

4.1 Beeloc provides an online service allowing the Customer to request the position of a phone by means of a location link sent by text message, together with Reverse Lookup features.

  • sending a Location Request to a number supplied by the Customer, together with a message written by them;
  • displaying the Position on a map within the Account, once the Recipient opens the link;
  • Reverse Lookup from a telephone number or a username;
  • retention of the request history within the Account;
  • email support.

4.2 Beeloc installs no software on the Recipient's device, does not access its contents and enables no continuous tracking. The Service operates only where the Recipient deliberately opens the link.

4.3 Information returned by a Reverse Lookup comes from publicly accessible sources. Beeloc does not warrant that it is complete, accurate or up to date.


5. Consent and lawful use

5.1 The Service rests on a deliberate act by the Recipient: no Position is transmitted unless and until they open the link they received.

5.2 The Customer must not use the Services to monitor any person without their knowledge or against their will. Such use breaches these Terms and may constitute a criminal offence.

5.3 The Customer warrants that they have a legitimate reason for each request and is solely responsible for the use they make of the information obtained, in particular under applicable privacy, data protection and electronic communications law.

5.4 The following are prohibited in particular: harassment, intimidation, stalking, impersonation, sending unlawful or misleading messages, and any use for the purpose of discrimination or of endangering another person.

5.5 Beeloc may suspend without notice any Account for which there are serious indications of use contrary to this clause, and may comply with requests from the competent authorities.


6. Account and credentials

6.1 Access to the Services requires the creation of an Account. The Customer provides accurate information and keeps it up to date.

6.2 Credentials are personal and confidential. The Customer is responsible for all activity carried out from their Account and must inform Beeloc without delay, at [email protected], of any unauthorised use.


7. Performance of the Service

7.1 Location Requests are carried by third-party telecommunications operators. Beeloc controls neither the delivery times of text messages nor any filtering applied by the operator or by the Recipient's device.

7.2 The Position comes from the location services of the Recipient's device at the moment the link is opened. Its accuracy depends on that device and its settings; where satellite positioning is switched off, the Position shown is approximate and derived from the mobile or wireless network in use.

7.3 No Position can be returned if the Recipient does not open the link or declines to share their position. That absence of a result does not constitute a failure to perform the Services under these Terms.

7.4 Beeloc owes an obligation of means as regards the availability of the Services and the obtaining of a result.


8. Price, taxes and payment

8.1 Prices are stated inclusive of all taxes, in the currency displayed at the time of the order. The applicable tax is that of the Customer's country of residence under the rules governing electronically supplied services.

8.2 Payment is made by payment card or by any other means offered at the time of the order. The Customer authorises Beeloc to charge that payment method on the agreed due dates.

8.3 Charges appear on the Customer's statement under the descriptor Beeloc.com. Billing queries should be sent to [email protected].


9. Trial Offer and subscription

9.1 Access begins with a Trial Offer of €0.90 giving access to the Services for 48 hours from subscription.

9.2 At the end of the Trial Offer, and unless cancelled before that point, the monthly subscription begins automatically at €49.00 per month, charged on the same date each month.

9.3 The subscription has no minimum term and may be cancelled at any time from the Account, on the terms set out in the Subscription Terms.


10. Right of withdrawal

10.1 A consumer Customer resident in the European Union has fourteen (14) days in which to withdraw, without giving reasons and without penalty.

10.2 By requesting immediate access to the Services when ordering, the Customer expressly requests performance of the contract before that period expires and acknowledges losing the right of withdrawal once the service has been fully performed, in accordance with applicable consumer law.

11. Availability, liability and force majeure

11.1 Beeloc endeavours to keep the Services accessible at all times, subject to maintenance and to incidents affecting third-party networks and providers.

11.2 Beeloc is not liable for indirect loss, nor for any harm resulting from the use the Customer makes of the information obtained.

11.3 In any event, Beeloc's liability is limited to the sums actually paid by the Customer during the twelve (12) months preceding the event giving rise to the claim.

11.4 Neither party is liable for non-performance resulting from an event of force majeure.


12. Intellectual property

12.1 The Beeloc brand, the Site, its architecture, its content and its developments remain the exclusive property of Beeloc Technology Limited (C 116833).

12.2 The Customer is granted a personal, non-exclusive and non-transferable right to use the Services for the duration of their subscription.


13. Personal data

13.1 The processing of personal data is described in the Privacy Policy, which forms an integral part of these Terms.

13.2 The Customer acknowledges that Location Requests involve the processing of data relating to third parties and undertakes to use them only in compliance with applicable law.

13.3 Any request relating to personal data should be sent to [email protected].


14. Suspension and termination

14.1 The Customer may cancel their subscription at any time from their Account; cancellation takes effect at the end of the current period.

14.2 Beeloc may suspend or terminate access in the event of a breach of these Terms, in particular clause 5, of non-payment, or of fraudulent use.


15. Governing law and disputes

15.1 These Terms are governed by the law of Malta, without prejudice to any more protective mandatory provisions of the consumer's country of residence.

15.2 The Customer should send any complaint to [email protected]. Failing an amicable solution, a consumer resident in the European Union may use the European online dispute resolution platform.

15.3 Failing amicable resolution, the courts of Malta have jurisdiction, subject to the protective jurisdiction rules applicable to consumers.
